Terms & Conditions for the StaycationGo platform

These Terms of Use ("Terms") constitute a legal agreement between you and Jeanna One Inc., a California corporation doing business as "StaycationGo" ("StaycationGo," "we," "us," or "our"). These Terms govern your use of our platform, website, applications, and related services (the "Platform"). By using the Platform, whether as a Host with an account or a Guest submitting a booking inquiry, you agree to these Terms and our Privacy Policy.

Dispute resolution notice. These Terms include a binding arbitration clause and class action waiver (Section 14). Unless you opt out within 30 days of your first use of the Platform, you agree to resolve disputes with StaycationGo through individual arbitration rather than in court. This provision does not apply where prohibited by your local law. Full details are in Section 14.

1. About StaycationGo

1.1 Our Role

StaycationGo is a technology provider. We build and operate property microsites, booking tools, and management software for short-term rental Hosts. Our role is to provide the software infrastructure that enables Hosts to list, market, and manage their properties.

1.2 Scope of Our Services

StaycationGo is not a party to the rental agreement between Hosts and Guests. We do not own, manage, operate, or inspect any property listed on the Platform. We are not a real estate broker, property manager, insurer, tour operator, or travel agent. We do not guarantee the accuracy of listing information, the condition or safety of any property, or the conduct or reliability of any Host or Guest.

The Host provides the accommodation. StaycationGo provides the technology.

1.3 Payment Structure

Guests pay Hosts directly for bookings. StaycationGo does not collect, hold, or process payments between Hosts and Guests. Payment terms, methods, and timing are determined between the Host and Guest.

Hosts pay a separate subscription fee to StaycationGo for access to the Platform, processed through Stripe. See Section 6 for subscription terms.

2. Accounts and Access

2.1 Eligibility

Hosts must be at least 18 years of age and legally capable of entering into a binding contract. Guests do not require an account to submit a booking inquiry, but by doing so, they agree to these Terms and our Privacy Policy.

2.2 Host Accounts

Host accounts are created by the StaycationGo team during onboarding. By accepting your account and using the Platform, you confirm that you have received, reviewed, and agreed to these Terms and our Privacy Policy.

You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account.

2.3 Identity Verification

Before a Host's listings are published, the Host must complete identity verification through our third-party verification partner. This may include submission of a government-issued ID, a selfie or photograph for biometric matching, and a background check. By participating in the onboarding process, you authorize StaycationGo and its verification partner to collect and process the required information as described in our Privacy Policy.

StaycationGo reserves the right to deny or revoke access if verification fails, information is found to be false, or our systems identify a concern.

2.4 Account Closure

Hosts may request account closure at any time by contacting hello@staycationgo.com. StaycationGo may suspend or terminate a Host account for violation of these Terms, fraudulent activity, failure to complete identity verification, non-payment of subscription fees, or any conduct that compromises user safety or Platform integrity.

Upon account closure, access to the Platform ends. The following provisions survive termination: Sections 10 through 14 and Section 17 (liability, indemnification, disclaimers, platform immunity, arbitration, and international users).

3. Host Obligations

3.1 Listing Accuracy

Hosts are responsible for the completeness and accuracy of all listing information, including descriptions, photographs, amenities, pricing, availability, house rules, and location. Listings must not be misleading. Photographs must depict the actual property. All listed amenities must be available and functional at the time of each Guest's stay.

In addition, Hosts must enter every required fee using the Platform's fee-entry fields as described in Section 9, and confirm that no required fee for any stay has been left out, labeled incorrectly, or excluded from the total price shown to Guests.

3.2 Legal Compliance

Hosts are solely responsible for compliance with all applicable laws governing their property and rental activity. This includes zoning and land use regulations, short-term rental licensing and registration requirements, building codes, health and safety standards, homeowner association and condominium rules, all applicable tax obligations, anti-discrimination laws (including the Fair Housing Act), and any consumer protection or privacy laws applicable based on the location of the Host's Guests, including Guests located outside the United States.

StaycationGo does not verify Host compliance with any applicable law. StaycationGo provides technology tools; compliance is the Host's sole responsibility.

3.3 Insurance

StaycationGo strongly recommends that all Hosts maintain commercial general liability insurance covering short-term rental activity, with a minimum of $1,000,000 per occurrence. Personal homeowner's or renter's insurance policies may not provide coverage for short-term rental activities. Hosts should consult their insurer to confirm the scope of their coverage.

Hosts may optionally provide proof of insurance during onboarding or at any time. StaycationGo does not verify, endorse, or guarantee the adequacy, validity, or ongoing status of any Host's insurance coverage. Providing proof of insurance does not create any obligation on StaycationGo's part to monitor, track, or enforce coverage.

Hosts who operate without commercial general liability insurance covering their short-term rental activity do so at their own risk and expressly assume full and sole liability for any and all claims, damages, injuries, losses, costs, fines, penalties, or expenses arising out of or relating to their property, their rental activity, or the conduct of their Guests, invitees, or occupants. Such Hosts acknowledge and agree that:

(a) they bear sole financial responsibility for any incident occurring at or in connection with their property, including bodily injury, property damage, and third-party claims;

(b) they shall not seek contribution, indemnification, apportionment, subrogation, or any other form of cost-sharing from StaycationGo arising out of or relating to the Host's property, rental activity, or Guest interactions, whether such claim sounds in contract, tort, statute, equity, or otherwise; and

(c) this assumption of risk applies regardless of whether StaycationGo provided technology, tools, or features used in connection with the booking, and is in addition to, and does not limit, the indemnification obligations in Section 11.

This Section 3.3 does not waive or limit any claim a Host may have against StaycationGo arising solely from StaycationGo's own gross negligence, willful misconduct, or fraud, or any liability that cannot be waived under applicable law. For the avoidance of doubt, nothing in this Section creates any insurance, indemnification, or defense obligation on StaycationGo's part.

StaycationGo is a technology provider. We do not own, operate, manage, or inspect any rental property. We do not provide insurance of any kind and assume no liability for events occurring at any Host's property.

3.4 Tax Obligations

Hosts are responsible for determining, collecting, reporting, and remitting all applicable taxes arising from their rental activity, including income tax, lodging or transient occupancy tax, and sales tax. StaycationGo does not collect or remit taxes on behalf of Hosts.

StaycationGo may report Host earnings to the IRS (Form 1099-K) and to state or local tax authorities as required by law. Hosts are required to provide and maintain accurate tax identification information.

3.5 Cancellation Policies

Each Host is responsible for establishing and communicating their own cancellation policy for each listing. The cancellation policy must be displayed on the listing page and made available to Guests before booking. The cancellation terms are part of the rental agreement between the Host and the Guest. StaycationGo is not a party to that agreement.

Hosts are solely responsible for ensuring their cancellation policy complies with all applicable laws in their jurisdiction and in the jurisdictions of their Guests. Certain jurisdictions provide consumers with mandatory cooling-off or cancellation rights that may override the Host's stated policy regardless of its terms. Hosts are responsible for understanding and honoring such requirements.

StaycationGo displays Host cancellation policies as provided by the Host. StaycationGo does not review, approve, endorse, or guarantee the legality or enforceability of any Host's cancellation policy.

3.6 Guest Data Responsibilities

When StaycationGo shares Guest information with a Host in connection with a booking inquiry (name, email, phone number, dates, and message), the Host assumes responsibility for the proper handling of that data. This includes using Guest data only for purposes related to the booking and stay, implementing reasonable security measures, refraining from selling or repurposing Guest data, and complying with all applicable privacy laws. The Host's handling of Guest data outside the Platform is the Host's responsibility, not StaycationGo's.

4. Guest Obligations

4.1 How Booking Works

Guests do not create accounts on StaycationGo. Guests submit booking inquiries through a Host's property microsite by providing their name, email address, phone number, preferred dates, and an optional message. This information is shared with the Host to facilitate the booking. The booking relationship, including payment, cancellation, and stay terms, is between the Guest and the Host.

4.2 Booking Commitments

By completing a booking with a Host, the Guest agrees to pay the Host according to the terms established between them, arrive and depart on the scheduled dates, comply with the Host's house rules, treat the property with reasonable care, and comply with all applicable laws during the stay.

4.3 Property Damage

Guests are responsible for any damage to a Host's property beyond normal wear and tear. Damage claims are resolved between the Guest and the Host. StaycationGo does not participate in financial disputes between Hosts and Guests (see Section 8).

4.4 Prohibited Conduct

Guests may not exceed the maximum occupancy stated in the listing, host events or gatherings without the Host's express written consent, engage in illegal activity on the property, disturb neighbors or violate local noise ordinances, sublease or transfer a booking to another person, or misrepresent the purpose of the stay.

5. Content and Intellectual Property

5.1 User Content

Users retain ownership of all content they submit to the Platform ("User Content"), including listings, photographs, reviews, and messages. By submitting User Content, you grant StaycationGo a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with operating, promoting, and improving the Platform. This license continues after account closure to the extent necessary to maintain Platform integrity (for example, published reviews remain visible on the property page).

5.2 Content Standards

User Content must not be false, misleading, or deceptive; infringe any third party's intellectual property or privacy rights; be defamatory, harassing, threatening, or discriminatory; contain malware, spam, or unauthorized advertising; or violate any applicable law. StaycationGo reserves the right to remove content that violates these standards without prior notice.

5.3 StaycationGo Intellectual Property

The Platform, including its design, features, code, logos, and trademarks, is owned by or licensed to Jeanna One Inc. and is protected by applicable intellectual property laws. Nothing in these Terms grants any right to use StaycationGo's trademarks or brand elements without prior written consent.

5.4 Copyright Complaints

If you believe content on the Platform infringes your copyright, submit a DMCA notice to hello@staycationgo.com (subject line: "DMCA Notice") including: identification of the copyrighted work, identification of the infringing material, your contact information, a statement of good-faith belief that the use is unauthorized, a statement under penalty of perjury that the information is accurate, and your physical or electronic signature.

6. Host Subscription

6.1 Plans and Pricing

Access to the Platform's hosting features requires an active subscription. Subscription plans, pricing, and features are communicated during onboarding and set forth in the Host's subscription agreement. StaycationGo may modify subscription plans and pricing with 30 days' advance notice to existing subscribers.

6.2 Billing

Subscription payments are processed through Stripe via a payment link provided during onboarding. Hosts are billed monthly or annually depending on their plan, in US dollars, at the beginning of each billing cycle.

6.3 Renewal and Cancellation

Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date. Hosts may cancel at any time by contacting hello@staycationgo.com. Cancellation takes effect at the end of the current billing cycle. No refunds are issued for partial billing periods.

StaycationGo sends a renewal reminder at least 7 days before each renewal date and retains subscription consent records for a minimum of 3 years.

California Hosts: This subscription is governed by California's Automatic Renewal Law (Cal. Bus. & Prof. Code §§ 17600 through 17606). By subscribing, you provided express affirmative consent to recurring charges during onboarding. You may cancel by contacting hello@staycationgo.com.

6.4 Failed Payments

If a payment fails, StaycationGo will attempt up to 3 additional charges over 14 days, with notification at each attempt. If the payment remains unresolved, the subscription will be suspended, listings will be unpublished, and account access will be limited to billing management until payment is restored.

6.5 Price Changes

StaycationGo provides at least 30 days' notice before any subscription price increase. The new price applies at the start of the next billing cycle following the notice period. Hosts who do not agree with the new pricing may cancel before the new billing cycle begins.

7. Reviews

7.1 Review Policy

After a completed stay, both Hosts and Guests may leave reviews. Reviews must reflect the reviewer's honest personal experience and comply with the content standards in Section 5.2.

7.2 Review Integrity

Users may not offer incentives (monetary or otherwise) in exchange for reviews, post reviews for bookings that did not occur, coordinate with others to manipulate ratings, or retaliate against a user for leaving an honest review. StaycationGo may remove reviews that violate this policy and take action against offending accounts.

8. Disputes Between Hosts and Guests

8.1 StaycationGo's Role

StaycationGo provides a communication channel to facilitate resolution of disputes between Hosts and Guests. StaycationGo does not mediate, arbitrate, or adjudicate disputes between Hosts and Guests. We do not make financial determinations, issue refunds, withhold payments, or take any financial position in Host-Guest disputes. StaycationGo is a technology provider and is not a party to the rental relationship.

8.2 Communication Channel

Either party may initiate a dispute conversation through the Platform's messaging system. Both parties are expected to make a good-faith effort to resolve disputes directly. All dispute communications conducted through the Platform are logged and retained as described in our Privacy Policy. These records may be used by either party as documentation in any subsequent legal proceeding.

8.3 External Resolution

If Hosts and Guests are unable to resolve a dispute through direct communication, either party may pursue resolution through any available legal channel, including small claims court, mediation, or arbitration, as applicable in their jurisdiction. StaycationGo may provide communication records in response to valid legal process.

8.4 Platform Integrity

StaycationGo reserves the right to take platform-level action based on patterns of user behavior, including issuing warnings, suspending listings, restricting account features, or terminating accounts of users who receive repeated verified complaints, engage in fraudulent conduct, or violate these Terms.

9. Pricing Transparency

9.1 All-In Pricing Requirement.

Every price displayed on the Platform for a listing—including in search results, on the listing page, on map displays, in the sticky price summary, in share previews, and in any marketing communication—must be the total price the Guest will pay for the stay, inclusive of the nightly rate, all cleaning fees, service fees, and any other mandatory fees or charges of any kind imposed by the Host or required for the stay. The only charges that may be excluded from the displayed total price are taxes and fees imposed by a government on the stay, which must nonetheless be clearly and conspicuously disclosed before the Guest confirms the booking and included in the final amount of payment.

9.2 Prominence.

The total price must be displayed more prominently than any other pricing information, including any per-night rate, subtotal, or itemized line item. Per-night figures may be shown only as a derived "average per night" label and may not be presented as the headline price.

9.3 Structured Fee Entry.

Hosts must enter every mandatory fee through the Platform's structured fee-entry fields, specifying the fee amount, type (per-stay, per-night, per-guest, per-pet, or other), purpose, and refundability. Hosts may not impose any mandatory fee that has not been entered through these structured fields and reflected in the displayed total price at the time of booking. Free-text descriptions, footnotes, asterisks, or external communications may not be used to introduce or qualify any mandatory fee.

9.4 No Post-Booking Fees.

Hosts may not introduce, impose, or attempt to collect any mandatory fee or charge that was not disclosed in the displayed total price at the time the Guest confirmed the booking. This prohibition applies regardless of how the fee is characterized.

9.5 Host Representation and Warranty.

By publishing or maintaining a listing on the Platform, the Host represents and warrants that (a) the fee information submitted through the structured fields is complete, accurate, and current; (b) no mandatory fee or charge applicable to the stay has been omitted; and (c) the Host's pricing presentation complies with all applicable federal, state, and local laws, where the Host's listing is offered or to which it is targeted.

9.6 Platform Tools.

StaycationGo provides structured fee-entry fields, total-price calculation, and display features as operational tools to assist Hosts in meeting their pricing-disclosure obligations. These tools do not constitute legal advice or a guarantee of compliance, and do not relieve the Host of independent responsibility for pricing accuracy and legality.

9.7 Scope.

This Section 9 applies regardless of the Guest's location.

10. Limitation of Liability

10.1 Exclusion of Damages

To the maximum extent permitted by applicable law, StaycationGo and its officers, directors, employees, agents, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to use of the Platform. This includes damages arising from Host-Guest disputes, property conditions, the conduct of any user or third party, Platform interruptions or errors, unauthorized account access, reliance on listing content, or claims from third parties (including Guests or government authorities) arising from a Host's rental activity or compliance failures.

10.2 Liability Cap

If StaycationGo is found liable for direct damages, its total aggregate liability shall not exceed the greater of (a) the subscription fees paid by the claimant to StaycationGo in the 12 months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).

10.3 Exceptions

Nothing in this section limits liability for death or personal injury caused by StaycationGo's negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited under applicable law.

10.4 Basis of the Bargain

These limitations reflect StaycationGo's role as a SaaS technology provider that does not participate in, control, or profit from individual Host-Guest transactions. StaycationGo's subscription pricing is established in reliance on these limitations.

11. Indemnification

11.1 General

You agree to indemnify, defend, and hold harmless StaycationGo, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your User Content, your violation of these Terms or any applicable law, your rental activity, or disputes between you and other users.

11.2 Host-Specific Indemnification

To the maximum extent permitted by applicable law, Hosts agree to indemnify and hold harmless StaycationGo for claims, losses, and expenses arising from the Host's own conduct, specifically:

  • The Host's violation of these Terms or the Privacy Policy.
  • The Host's violation of any applicable law, including privacy, consumer protection, tax, safety, licensing, and anti-discrimination laws.
  • Claims from Guests (regardless of location) arising from the Host's rental activity, property conditions, or interactions with the Guest.
  • The Host's User Content, including listings, photographs, descriptions, and reviews.
  • The Host's handling of Guest personal data outside the Platform.
  • Claims, government investigations, civil penalties, fines, refunds, settlements, judgments, or losses that arise from the Host providing inaccurate, incomplete, or wrongly labeled pricing or fee information; from the Host charging any fee that was not included in the total price shown at the time of booking; or from any other breach of Section 9.

Exclusions. This indemnification does not apply to losses caused by StaycationGo's own breach of these Terms, negligence, or willful misconduct. Hosts are not required to indemnify StaycationGo for regulatory fines or penalties imposed on StaycationGo for StaycationGo's own compliance failures. Where both the Host's conduct and StaycationGo's conduct contributed to a loss, indemnification applies only to the portion attributable to the Host.

EEA, UK, and equivalent consumer jurisdictions. For Hosts who are consumers in the EEA, UK, or a jurisdiction with comparable consumer protections, this indemnification applies only to losses adequately caused by the Host's culpable breach of these Terms and does not extend beyond what is foreseeable and proportionate under local consumer protection law.

Duration. This obligation survives account closure for 4 years or the applicable statute of limitations for the underlying claim, whichever is longer.

12. Disclaimers

The Platform is provided on an "as is" and "as available" basis. StaycationGo makes no warranties, express or implied, regarding the Platform's uninterrupted or error-free operation, the quality, safety, legality, or suitability of any listed property, the accuracy or completeness of any listing information, or the conduct, reliability, or identity of any user.

StaycationGo does not represent or warrant that Hosts comply with applicable laws in their jurisdiction or the jurisdictions of their Guests. The Platform provides tools designed to help Hosts meet common legal requirements. These include cancellation policy tiers, fee-entry fields, total-price calculation and display, and cookie consent mechanisms, among other features. These tools are intended to support compliance, including with all-in pricing rules, but they do not constitute legal advice and do not guarantee compliance in any jurisdiction. Hosts remain solely responsible for confirming that their use of the Platform follows all laws that apply to them.

13. User-Generated Content and Platform Immunity

StaycationGo is a provider of an interactive computer service within the meaning of 47 U.S.C. § 230. Listings, reviews, messages, and photographs are created by users, not by StaycationGo. StaycationGo is not the publisher or speaker of User Content. The moderation, editing, or removal of User Content does not alter this status.

StaycationGo complies with the TAKE IT DOWN Act (18 U.S.C. § 1309) and will remove non-consensual intimate imagery within 48 hours of receiving a valid report at hello@staycationgo.com (subject line: "TAKE IT DOWN Request").

14. Dispute Resolution Between Users and StaycationGo

This section governs disputes between you and StaycationGo. For disputes between Hosts and Guests, see Section 8.

14.1 Agreement to Arbitrate

You and StaycationGo agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved through binding individual arbitration, except that either party may pursue an individual claim in small claims court if the claim qualifies.

This agreement is governed by the Federal Arbitration Act (9 U.S.C. §§ 1 through 16).

14.2 Pre-Arbitration Notice and Negotiation

Before initiating arbitration, the complaining party must send a written Notice of Dispute to the other party (StaycationGo's address: hello@staycationgo.com, subject line: "Notice of Dispute") describing the nature of the claim, the relief sought, and the relevant facts. The parties will attempt to resolve the dispute informally for 60 days following receipt of the Notice.

14.3 Arbitration Procedures

Arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. If AAA is unavailable, the parties will select an alternative arbitration provider by mutual agreement, or a court will appoint one.

Arbitration is conducted in English. Unless the parties agree otherwise, arbitration takes place in the county where the claimant resides. For claims under $25,000, the claimant may elect proceedings in person, by phone, by video conference, or based on written submissions.

In compliance with California law, arbitration is seated in California and California substantive law applies.

14.4 Fees and Costs

For claims under $75,000, StaycationGo covers all AAA filing, administrative, and arbitrator fees, except where the arbitrator determines a claim to be frivolous. For claims exceeding $75,000, fees are allocated according to AAA rules. Each party bears its own attorneys' fees unless the arbitrator awards fees to the prevailing party.

StaycationGo will pay all required arbitration fees within 30 days of invoice, as required by California Code of Civil Procedure § 1281.98. Failure to pay within this period constitutes a material breach and waiver of the right to compel arbitration.

14.5 Class Action Waiver

All disputes are resolved on an individual basis. Neither party may participate as a plaintiff or class member in any class action, collective action, consolidated action, or representative proceeding. The arbitrator may not consolidate claims from multiple parties or preside over any form of class proceeding.

If this class action waiver is found to be unenforceable, the entire arbitration agreement in this Section 14 shall be void, and disputes shall proceed in the courts described in Section 14.9.

14.6 Opt-Out Right

You may opt out of this arbitration agreement within 30 days of your first use of the Platform. To opt out, send written notice to hello@staycationgo.com (subject line: "Arbitration Opt-Out") including your full name, email address, mailing address, and a clear statement that you wish to opt out. If you opt out, disputes will be resolved in court as described in Section 14.9. Opting out does not affect any other provision of these Terms.

14.7 Batch Processing of Mass Claims

If 25 or more similar disputes are filed against StaycationGo within a 60-day period, the following batch process applies:

Concurrent batch administration. Claims are grouped into batches of 100 and administered concurrently. Each batch proceeds through arbitration simultaneously. No claim is stayed or delayed while another batch resolves. If fewer than 100 claims remain after batching, they proceed as a final batch.

Mandatory global mediation. After the first batch of arbitrations concludes, both parties participate in a single global mediation session before a mediator mutually agreed upon or appointed by AAA. The purpose is to explore resolution of all remaining claims based on the outcomes of the first batch. Mediation costs are split equally.

Continuation. If mediation does not result in a global resolution, remaining claims continue in successive batches of 100 until all are resolved.

Tolling. All applicable statutes of limitations and filing deadlines are tolled for claims in pending batches from the date the batch process is triggered until 60 days after the claim's batch is scheduled for arbitration.

No binding precedent. The outcome of any individual arbitration within a batch does not bind or create precedent for any other arbitration. Each claim is resolved on its own facts.

14.8 International Users

This arbitration provision applies to all users. Where mandatory local law in the user's jurisdiction of residence prohibits pre-dispute binding arbitration of consumer claims, that prohibition is honored. In such cases, disputes are resolved in accordance with Section 17.

14.9 Judicial Forum

If this arbitration agreement is found to be unenforceable or the user has timely opted out, disputes shall be brought in the state or federal courts located in Los Angeles County, California. Both parties consent to personal jurisdiction and venue in those courts, subject to Section 17 for users outside the United States.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law provisions, except as preempted by federal law (including the Federal Arbitration Act). For international users, see Section 17.

16. Platform Rules

16.1 Acceptable Use

Users agree not to use the Platform to violate any applicable law or regulation, infringe any intellectual property or privacy rights, discriminate on the basis of any protected characteristic, harass, threaten, or abuse other users, transmit malware, spam, or unauthorized advertising, scrape or access the Platform through automated means without written permission, circumvent identity verification or security measures, or manipulate search rankings, reviews, or other Platform features.

16.2 Prohibited Listings

The following types of listings are not permitted: properties the Host does not have the legal right to rent, properties that violate applicable short-term rental laws or regulations, properties with known health or safety hazards, properties containing undisclosed surveillance devices (exterior security cameras disclosed in the listing are permitted), shared spaces represented as private accommodations, and listings containing intentionally misleading photographs or descriptions.

16.3 Anti-Discrimination

Hosts and Guests are required to comply with all applicable anti-discrimination laws, including the Fair Housing Act. Hosts may not decline bookings based on any protected characteristic. Hosts may establish reasonable, non-discriminatory house rules related to property safety and preservation. Violations of this policy may result in account suspension or termination.

16.4 Platform Communications

Booking-related communications between Hosts and Guests should be conducted through the Platform's messaging system. This creates a documented record that serves both parties. StaycationGo may monitor communications for safety, fraud prevention, and policy compliance, but does not review private communications except in response to valid legal process, reports of safety concerns or policy violations, or automated systems designed to detect fraud or spam.

17. International Users

17.1 Applicability

This section applies to all users who reside outside the United States or who access the Platform from outside the United States.

17.2 StaycationGo's Role

StaycationGo is a US-based technology provider. The Host, not StaycationGo, is the party offering accommodation services to Guests. Consumer concerns regarding the accommodation itself, including its condition, the Host's conduct, pricing, refund policies, or the Host's compliance with local laws, should be directed to the Host.

Concerns regarding the Platform (account access, data handling, software functionality) may be directed to StaycationGo.

17.3 Governing Law and Local Protections

California law governs these Terms (Section 15). However, if you are a consumer and your jurisdiction's mandatory consumer protection laws provide that you cannot be deprived of local protections through a choice-of-law clause, those mandatory protections apply to the extent required by law. Nothing in these Terms prevents you from bringing a claim before the courts or regulatory bodies of your country of residence where your local law provides that right.

17.4 Arbitration

The arbitration provision (Section 14) applies to international users unless mandatory local law in the user's jurisdiction prohibits pre-dispute binding arbitration of consumer claims. Where such prohibition applies, disputes between the user and StaycationGo shall be resolved in the courts of the user's jurisdiction of residence or in Los Angeles County, California, at the user's election.

17.5 Liability and Disclaimers

The limitation of liability (Section 10) and disclaimers (Section 12) apply to the maximum extent permitted by the laws of your jurisdiction. Where your local law does not permit a specific exclusion or limitation, that specific provision does not apply to you. The remainder of Sections 10 and 12 continues in full force.

17.6 Platform Compliance Features

StaycationGo designs its Platform features to accommodate common legal requirements across jurisdictions. Cancellation policy tiers are structured to accommodate mandatory cooling-off periods. Pricing display includes all mandatory fees. Cookie consent provides opt-in for non-essential cookies. These features are provided as operational tools and do not constitute legal advice or a guarantee of compliance.

Hosts remain solely responsible for ensuring their use of the Platform complies with all laws applicable in their jurisdiction and in the jurisdictions of their Guests.

17.7 Data Storage

Platform servers are currently located in the European Union (Finland) and are in the process of migrating to the United States. See our Privacy Policy, Section 6 for details on data storage and user rights.

18. General Provisions

Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and StaycationGo with respect to the Platform.

Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions continue in full force and effect.

No Waiver. StaycationGo's failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment. You may not assign or transfer your rights or obligations under these Terms without StaycationGo's prior written consent. StaycationGo may assign its rights and obligations in connection with a merger, acquisition, reorganization, or sale of assets, with notice to affected users.

Force Majeure. StaycationGo is not liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, pandemics, war, government actions, power outages, internet failures, or labor disputes.

Electronic Communications. By using the Platform, you consent to receiving communications from StaycationGo electronically. Electronic communications satisfy any legal requirement that communications be in writing.

Modifications. StaycationGo may modify these Terms from time to time. Material changes will be communicated with at least 30 days' advance notice through the Platform and by email. Continued use of the Platform after the effective date of modifications constitutes acceptance. A changelog of modifications is maintained at [staycationgo.com/journal/terms-changelog].
